The definition of what constitutes “economic benefit” in (2) is somewhat hazy. Here’s what is clear. If there is money raked from pots, or a seat time charge, or a door fee, or a mandatory food charge, or a mandatory “donation”, the game is illegal under Texas law since that money is going to somebody, and they are getting an “economic benefit” from the gambling.
It is a little more hazy if you’re playing in a game where there’s no rake or game charge, but there is a dealer or waitress who is getting tipped. That’s probably still illegal. Genuinely voluntary donations, or asking people to chip in for beer or pizza, or selling someone something like cigarettes during the game, probably would still make the game technically illegal but it seems extremly unlikely that anything like that alone would cause a game to get busted.
There has been at least one case where the illegality of a poker game was established. In Gaudio v. Texas 1994, Gaudio was convicted of keeping a gambling place which in this case was an apartment rented to play poker games. The judge ruled that what made the game illegal was that the pots were raked to pay the rent of the apartment and that since not having to pay the full rent of the place was an economic benefit, the game was illegal. The judge also said, though, that even if the pot wasn’t raked, the fact that the dealer and waitress received tips probably made the game illegal.

In Texas the answer is yes, but rarely. The only cases in the last several years I’ve heard of have been two high-profile operations, the Austin Poker Club which was shut down in April 2003 (see here) and the Redmen’s club, shut down in February 2004 (see here). Neither has gone to trial yet.
Little one- or two- table home games, illegal or legal, rarely attract the attention of the law anywhere in the US. Larger illegal cardrooms or poker clubs more frequently do because they are a higher profile and easier to prosecute.
The Austin Poker Club was a very high-profile club. They were trying to operate as a legitimate business, including having a public website, a labeled location, membership dues and apparently even paying taxes. The owners believed, and still do, that their club was legal. Only the outcome of the trial will determine that for sure.

Probably not too much. You’d almost certainly be questioned for several hours about the game, probably at a police office. You’d probably lose your buyin and the chips you had in front of you.

Burning up my FPPs on sanghoki…
As mentioned in a previous post, I told you that I no longer played poker online due to a number of various reasons. Well I guess I need to justify that by saying that I no longer play poker online for real money. I had about 1500 FPPs built up on sanghoki from my approx. 3 month stint playing online. I have been slowly but surely burning those FPPs up and am down to about 200. Last night I played in a 60 FPP buyin event on sanghoki which would get me into a 6000 FPP event which would then get me into a buyin for the Monte Carlo event coming up that they are having in Europe.
The tournament starts with 400 or so. This was the 1st time in about 2 or 3 months that I actually played using FPPs. I started off a little rusty and then things get interesting when I am dealt AA UTG
I think to myself early in the tournament online with this kind of hand means 20xBB bet. I NEVER limp with aces. In my experience if you don’t bet big online you get everybody and their mother limping in for 1xBB to 5xBB and flopping 2 pair especially early in tourney with the weaker players still lurking about.
Anyways… I bring it in for 400 and get 2 callers.
Flop Comes: J9Q
Not a very good flop when you are holding pocket rockets. I check. 2 seats to my left bets 600 and the button folds. I go into the tank and am about to fold when the guy says verbatim “You should fold bitch!”. I get emotional when I play online. If this would’ve happened in the casino I would’ve smiled and folded but oh no. Not here. I get pissed and push them all to the middle. Josh Arieh Jr. calls and flips up the A9. The flop then comes rag, rag and I knock him out which puts me in position to sit back and coast for a while.
I continue on playing extremely well in my opinion staying in the middle of the pack the whole tournament. I make it through 2 breaks and the following hand comes up with about 57 people left and me sitting about 20th or so with a stack of about 19K. Chip leader is like 68k or something so I don’t mind where I am at right now.
The blinds are 400/800 with a 50 ante and I am dealt KJ
Everyone folds around to me and I am 2 seats off the button so I raise to 1600. The SB folds to the BB and the BB limps.
Flop Comes:88Q
He checks and I bet 1600. Something just doesn’t feel right here. He doesn’t have an 8 or a Q. At this point I haven’t put him on anything yet but I just think I have the best hand right here. A raise here would’ve pushed me out but he limps. This shows me more weakness.
Turn Comes:8
I don’t know why (maybe it was the subconscious knowledge of how the fella had been playing) but I don’t think he has me beat. I figured he might have a K-10 or something. Maybe an A (in which case I am beat) but I didn’t think so for some reason. Anyways… He comes out betting. The minimum bet. Is this a tease??? I think I can put him away. I push’em to the middle and he calls immediately.
I never put him on a pocket pair. He flips up 66
Dang. I think. He has me covered up (with about 40k) and I am gone. BUT WAIT…
The river brings the J and I double up to about 40k.
From here things get a bit boring for about 30 minutes or so. I play a few hands and fold alot of hands and am sitting at about 5th out of 16. With the top 4 all ranging in stacks from 80 to 100k I have about 40k or so still.
Then my Mike Matusow blowup happens… We are down to 7 at our table. 15 total players are still left.
I am UTG dealt AQ
I raise to 4800 with the blinds at 600/1200. Only 1 caller. The chip leader at my table (and the tournament for that matter) who is sitting on the button limps in.
Right here I think I make the right read and put him on maybe an A or K high card only. I figure he is playing his position and wanting to see a flop.
Well the flop comes: 263 and I check thinking that didn’t hit either one of us but I am definitely in the lead.
The button pushes and bets 3200. I call quickly and the turn comes 9
I check here and the button bets 3200 again. I feel like I have the best hand here and I raise to 6400 pretty quickly.
The button goes into the tank. Now while he is in the tank I will tell you what I am thinking here. I am thinking he has an Ace with a lower kicker than me but he hasn’t paired the board.
The button comes back and raises me to 17k and change. Now I really think I have him beat since he overbets the pot like he did and I haven’t ever seen him bet like that before in the 45 minutes that I have seen him playing. I push allin and the button goes into the tank.
I think he is about to lay it down right here and choose to fight another day but he calls half his stack with….. A3
Damn…. Now I have one card and one card only that will save me and when the J falls on the river I get put out in 15th.
Did I play this hand wrong? I feel like I read the guy right but since I got knocked out I feel like I did something wrong
I am glad that I did put him on a bluff hand though when he overbet the pot like he did. Betting a 3rd button pair on the board like that is a bluff in my opinion…. Okay maybe I will give him a semi-bluff.
Anyways… let me know what you think about the plays that I have mentioned. I would really like to know what you think about the play that I got knocked out with. I think I should’ve bet after the flop and then been willing to let my hand go after his raise on the turn but I don’t know. What would you have done given the circumstances.

Slot Demo whoops…
For all that talk about the $100,000 tournament being my big chance, I sure Slot Demo come through — I saw ONE showdown the whole time. Oh well.
I busted just before the first break, moving my stack (T775) all in with ATo on a flop of rainbow 587. I had raised it to 2x the BB PF, and gotten two callers. I think I was steaming a little, but I did genuinely sense weakness, and I had position, so I thought it was a good time to steal. Fox and the farmer, right?
I hadn’t played a hand to a showdown all tourney at this point. I had seen only three turn cards. I just wasn’t catching any starters at all, stuff like Q5o, J2, was the rule — which was fine. Slot Demo Then, with blinds 25 and 50, I got TcTs with T1265 and made it T150 to go. Two callers, and the flop came down Axx, all spades, no straights to my memory. I liked this flop, even with the Ace. I bet out T200, and get called by one guy, which I hated. Turn is a meaningless 5h, I bet small trying to keep myself in the hand while keeping the initiative, and figuring my opponent on an Ace or a large unpaired spade. Probably an Ace.
He moves all in, and I go into the tank. Hindsight is 40/40, but maybe this was a good place to call with 12 outs to a probable winner (unless he held AA, or had the K, Q, or Js, or paired cards bigger than TT that river a set). I just couldn’t bring myself to move it all in in the first hour on that kind of draw. It was all so uncertain. So I folded, leaving myself T865.
Then, the next hand I get ATo, which I mentioned above. I moved in when I sensed weakness and was immediately called by the same guy I was up against last hand. Crap. He turns over 77, and I need runner-runner for a set or a straight to win. It doesn’t come, and I’m dead. He needed a big hand to call my all-in bet there, and he had it. Life goes on.
I will say this, though: it was interesting, the whole process of playing into this big tourney. I think it was very valuable experience, and I’m glad I did it, even if I lose. My $9 investment ultimately got me a real shot (1 in 342 entrants) at a $20,000+ first prize and a $100,000 overall prize pool. The lessons: patience when you still have a workable number of chips (all in with ATo and 15x the BB and no pairs is a bad idea!), patience when you’re not getting any cards, and don’t tilt when you have to lay a decent hand down.
My final finish — 250 of 342. Not very good, but then again, I wasn’t out first, and I had a real shot at something completely out of my normal boundaries. It was worth it.

WSOPHD Sihoki
I may be the only geek that even thought of such a thing, but I’ve been wondering for a while if I needed to consider biting the bullet and upgrading to ESPNHD in time for the WSOP. Everything’s better in high-definition, and imagine the Sihoki coming to you in crisp, clear, bright beautiful color. The felt is that much greener, Phil Gordon’s eyes are that much bluer, and you can really make out the agony on a player’s face when the soul-crushing bad beat hits on the river.
I asked an ESPN rep if I needed to upgrade for this year’s WSOP, and he said no, but that next year’s would be coming to us in HD. He also mentioned that it’d probably be cheaper Sihoki if you were to sign up for the service now rather than next year, but I’m pretty sure I know a marketing ploy when I hear it. Personally, I’ll wait.

From Norwalk, Conn., Joe Lloyd, 35, also survived Day 1. Qualifing via the PartyPoker Steps tournaments, Joe said last level was rough. Throughout the day he had worked his way up to $45,000, but ended the day with $25,000.
Player Profile: Marice Cooke
Marice Cooke started today as one of the ladies’ overall chip leaders with 55,875. She had at least that, if not more in her stack when I caught up with her at the end of the first break. Marice earned her Main Event buyin through a $3 rebuy satellite on Party Poker– not a bad return on her investment.
Remarkably, Marice has only been playing no-limit hold’em for six months. With a cool stare and quiet confidence, I’d say she already has an awesome poker face.
Player Profile: Alvaro Macias
Alvaro Macias, 34, paid $60 for his seat at the WSOP main event. The PartyPoker online player qualified through the Steps tournaments. Not only is this Macias’ first WSOP, but it is his first time playing live poker. He said playing live is logistically difficult because online the computer tells you everything. Physically handling and counting his chips is a little more of a challenge as well as having to think through his playing options.
“The computer tells you what your options are,” he said. “Also not being able to see my cards during the whole hand is difficult. Sometimes I look at my cards once and then forget what I have after I have bet.”
Macias suffered a bad beat earlier in the day shrinking his stack to $3000, but worked his way back to end Day 1 with $15,000.
